The implementation of “labor contract law” has entered the 5th year period, with the twice fixed-term contract, the phenomenon and dispute of renewing the open-ended contract will appear blowout. At present, although the law has regulated such as “work for 10 consecutive years” and “twice renewal” etc. the legal situation of signing the open-ended contract, but in practice, how to define and actual standard is still very vague and controversial. 培训师 About The Trainer:董保华
董保华先生现任上海交通大学凯原法学院、华东政法学院教授、博士生导师,中国法学会社会法研究会副会长、中国劳动法学研究会副会长,上海市劳动和社会保障学会劳动法专业委员会主任委员,上海市法学会劳动法研究会总干事、中国律师协会劳动法专业委员会委员、上海市董保华律师事务所律师、华东政法学院劳动法律服务中心主任。
曾参与《中华人民共和国劳动法》论证和起草工作。1987年开始从事劳动法学研究以来,公开发表有关劳动法律方面的论著约400余万字。撰写劳动法方面的著作主要有《劳动的法律保障》、《中国劳动法学》、《劳动法教程》、《“劳工神圣”的卫士——劳动法》、《社会保障法律制度》、《劳动法原理》、《劳动法论》、《劳动关系调整的法律机制》、《社会法原论》、《劳动合同研究》、《社会保障的法学观》、《劳动法精选案例——六重透视》、《劳动关系调整的社会化与国际化》等。公开发表论文200余篇,其中在法学、劳动科学方面国家级的核心期刊上发表的论文100多篇并有50多篇论文获得司法部或上海市等有关部门评选的优秀论文奖;同时,还主持或参与10多项司法部或上海市有关部门的研究课题并多次获奖。参与了美国、荷兰、加拿大等10多项各类国际项目的主持与实施。
董保华教授善於处理劳动法领域疑难案件,在兼任众多社会工作的同时还担任了强生、家乐福、上海市企业家联合会等数十家公司企业的常年法律顾问。董教授还经常应邀参加全国范围内各级法院及社会其他阶层的讲课,具有丰富的讲课经验,有极强的理论知识与实际操作经验。
Dong Baohua is the professor and Ph.D. supervisor of Koguan Law school of Shanghai Jiao Tong University, the vice president of Law Research Association of China Law Society, the vice president of the Law Research Association of China Labor Law, the executive director of China Law Association, the committee of Labor Law Association of Shanghai Labor Law, the director of Labor Law Research of Shanghai Law Association, the lawyer of Shanghai Bao Hua Law Firm and the center director of East China University of Politics.
He participated in the demonstration and draft of “people’s republic of China Labor Law”. Started working in jurisprudential study since 1987, he published works about 400 words on labor law. Write the famous works about labor law:
Professor Dong Baohua is good at handling the difficult cases in the field of labor law, and served as the legal counsel in Johnson & Johnson, Carrefour, Shanghai Entrepreneurs Association and other dozens of companies. Professor Dong is frequently invited to give lecture to all levels of courts and other social classes; he has rich teaching experience, strong theoretical knowledge and practical experience.
