课程背景Course Background
近日，《反不正当竞争法》修订草案正式提交全国人大常委会审议，成为自1993年施行以来的首次修订。现行法律是在国家由计划经济向市场经济转轨的大背景下出台，随着我国市场经济的发展，新的商业模式不断出现，现行规定很多内容与当前经济社会发展已无法适应。为了保障国家市场经济的稳定繁荣，保护经营者合法权益，此次修法意义重大。本次修法一大亮点是修订了商业贿赂的有关规定，对商业贿赂的适用范围有所扩大，对责任主体的认定原则也做了重要调整，并且加强了警方与工商行政管理机关的工作衔接。为辨析反不正当竞争法的巨变，我们特别邀请到行业专家王峰律师来详解《反不正当竞争法》修订草案，同时分析企业所面临的新合规风险,以及高管的刑事责任风险。
Recently, the "Anti-Unfair Competition Law" revised draft formally submitted to the NPC Standing Committee to consider, since 1993, since the implementation of the first revision. 讲师介绍Speaker Introduction
王峰律师毕业于华东政法大学，获法学硕士学位。现任北京大成（上海）律师事务所合伙人，曾先后在公安机关、检察机关工作7年，担任警官、检察官，从事各类刑事犯罪、经济犯罪案件的侦查、批捕、起诉工作，办理数百起案件，多次荣获省级表彰，并立个人二等功。担任专职律师以来，主要从事金融、经济、职务犯罪案件的研究与办理，并担任多家“世界五百强”企业的法律合规顾问，为企业提供反商业贿赂、反舞弊腐败、反欺诈、企业及高管刑事法律风险预防，以及金融证券领域的非法集资、内幕交易、操纵市场、虚假陈述、洗钱等风险防范服务。
代表性客户包括但不限于：联合利华、妮维雅、富士、大陆、蒂森克虏伯、基华物流、赛默飞、诺华制药、赛生药业、中国石油、中国平安、钜派投资等。
